Dozent is an audio-tour app, operated by Edward Ho Kiu Yung, a sole proprietor ("we", "us"). These terms are the agreement between you and us for using it. By using Dozent you accept them. If you do not accept them, please do not use the app.
You must be at least 13 years old. If you are under the age of majority where you live, you may use Dozent only with a parent or guardian's involvement. You must not use Dozent if we have previously terminated your account.
You can browse and listen without an account. Creating one lets your library, purchases and listening history follow you between devices, and is required to publish tours.
Give accurate information when you sign up, keep your credentials secure, and tell us promptly if you believe your account has been compromised. You are responsible for what happens under your account. One person, one account; do not share it or transfer it.
Some tours are free and some are paid. All purchases are made through Apple's In-App Purchase system and are also subject to Apple's terms. Apple processes the payment; we never receive your card details.
A purchase grants you a personal, non-transferable licence to listen to that tour for as long as it remains available and your account exists. You are buying access, not ownership, and you may not redistribute, resell, rebroadcast or publicly perform a tour's audio.
Refunds are handled by Apple under Apple's own policy — request them from Apple, not from us. When Apple grants a refund your access to that tour ends.
Creators set their own prices and may change them. A change never affects a tour you have already bought. Tours can be removed by their creator or by us; if a tour you purchased is removed for reasons other than your own breach of these terms, contact us.
If you publish tours ("creator"), this section also applies to you.
You keep ownership of everything you upload — audio, photographs, text. By publishing, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt for formatting, distribute, publicly perform and display that content in and in connection with Dozent, including promoting the app. This licence exists so we can operate the service, and it ends when you remove the content, except for copies retained by people who already purchased it and copies in routine backups.
Every tour is reviewed by a person before it can be published, and we may reject it. We may also remove or unpublish a tour at any time if we believe it breaches these terms or our Acceptable Use Policy, or if we are required to. Where practical we will tell you why, and you may appeal by writing to us.
When someone buys your tour, Apple takes its commission first. Of the amount we then receive, we retain a platform fee of 20% and the remainder is credited to you. We will give at least 30 days' notice before changing this fee, and a change never applies to sales already made.
Payouts are made monthly through Stripe. You must complete Stripe's onboarding, including its identity verification and tax documentation, before we can pay you; you provide those details to Stripe directly. Because Apple pays us roughly 30 to 45 days after the end of the month in which a sale occurs, your payout follows on the same delay. We may withhold a payout where we reasonably suspect fraud, or where a sale has been refunded or charged back.
You are responsible for your own taxes on what you earn. We are not your employer, partner or agent; you publish as an independent party.
Your use of Dozent is governed by our Acceptable Use Policy, which forms part of these terms. In addition, do not reverse-engineer the app, attempt to circumvent payment or access controls, scrape or bulk-download the catalogue, disrupt the service, or use it to break the law.
Dozent is used outdoors, while walking. Your safety is your responsibility. Pay attention to traffic, other people and your surroundings, and do not follow a route or instruction that seems unsafe. Never use the app while driving or cycling. Routes and coordinates may be inaccurate or out of date, and places may be closed, altered, on private land or unsafe to reach. Obey local laws, signage and property rights, and use your own judgement about whether it is sensible to be where a tour suggests.
The Dozent name, logo, app and its design are ours. These terms give you no right to use our branding. Tours produced by us remain ours.
You may stop using Dozent at any time and may ask us to delete your account. We may suspend or terminate an account that breaches these terms, that we are legally required to act on, or that creates risk for other users. Serious breaches — fraud in particular — may result in immediate termination and forfeiture of any unpaid balance. Sections that by their nature should survive termination do so, including content licences already granted to purchasers, disclaimers and limitations of liability.
We may change, suspend or discontinue any part of Dozent. We aim to give reasonable notice of significant changes, but the service is provided without any guarantee of uninterrupted availability.
Dozent is provided "as is" and "as available". To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that tour content is accurate, complete or current — much of it is created by other users, and we do not independently verify every historical or factual claim in it.
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Our total liability arising from your use of Dozent is limited to the greater of the amount you paid us in the 12 months before the claim, or 50 US dollars. Some jurisdictions do not allow these limits, in which case they apply only as far as the law permits, and nothing here limits liability for death or personal injury caused by negligence, or for fraud.
If you publish content on Dozent, you agree to indemnify us against claims, losses and reasonable legal costs arising from that content or from your breach of these terms.
We may update these terms. The "Last updated" date above will change, and we will give notice in the app for material changes. Continuing to use Dozent after a change means you accept the updated terms.
These terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-laws rules, and the courts located there will have jurisdiction — except where the law of your country of residence gives you the right to bring proceedings locally.
